Real estate | GETTING READY FOR YOUR CLOSING

The closing is the procedure by which the title to the property is transferred from the seller to the purchaser. If the purchaser has obtained a loan, the lender's required documents are executed at this time. In the state of South Carolina, the closing must take place under the direction of an attorney. In preparation for this event at our law firm, consider the following pointers to facilitate a smooth closing:

For the seller:
For the Buyer:
For the Realtor:
For the Lender:

For the seller:

Prior to Closing, we will need from you:

  1. Full Names of all parties on the title to the property
  2. All relevant information regarding your Homeowners Association, such as contact person, yearly or monthly fees, mailing address, and any amounts paid or due.
  3. Any payoff information on any and all loans secured by your property, including:
    • Social security numbers for all parties on loan;
    • loan account number;
    • lender's name, address and telephone number;
    • copy of payment coupon or most recent account statement;
  1. Copies of invoices for any repairs that are to be paid from closing proceeds.
  2. Copy of the Termite Letter
  3. Copy of Heating and Air Letter
  4. Copies of any relevant Wills, Trusts, Powers of Attorney or Corporate Documents related to the Seller

8. Copies of any restrictive covenants

Please bring the following to your Closing:

  1. Photo identification for all parties on Title (Please Note: the name on I.D. must match the name on the Title to the Property)
  2. The Original Termite Letter
  3. Any Home Warranty information, if applicable
  4. Copies of invoices for any repairs, if applicable
  5. Keys and/or garage door openers to the property
  6. Bring corporate seal and original corporate resolution, if you are executing documents on behalf of a corporation. If you are signing for a Limited Liability Corporation (LLC), bring the LLC seal if you have one, and a copy of your LLC Operating Agreement.
  7. Bring original Power of Attorney, if you are signing on behalf of an absent seller.
  8. If a Power of Attorney is to be used, and has been prepared or approved by our Office, the Original executed Power of Attorney

 

For the Buyer:

Prior to Closing, we will need the following items from you:

  1. Original fully executed sales contract
  2. Please provide full names of all persons who will be on title
  3. Your Homeowners/Hazard Insurance policy information
  4. Decide if you want a new survey . . For more information about the importance of surveys, please click here. (go to page on surveys)
  5. Copies of any relevant Wills, Trusts, Powers of Attorney or Corporate Documents related to the Buyer/Borrower

Please bring the following to the Closing:

  1. Photo identification (Please Note: the name on the I.D. must match the name on the Closing documents)
  2. Certified funds for the amount shown on your preliminary HUD-1 Settlement Statement.
  3. Your personal checkbook to cover any last minute adjustments to the HUD-1 Settlement Statement at Closing
  • If a Power of Attorney is to be used, and has been prepared or approved by our Office, the Original Executed Power of Attorney

For the Realtor:

Prior to Closing, we will need from you:

  1. A Copy of a signed contract, including any and all addendums
  2. Contact information for the Buyers and Sellers
  3. Name and contact information for the Mortgage Lender or Mortgage Broker
  4. Homeowners Association contact information, including contact name, address and telephone number
  5. A Copy of the Termite Letter
  6. A Copy of Heating and Air Letter, if applicable
  7. All payoff information for the Seller, including contact information for each loan, account numbers and Social Security numbers for all parties on the loan and a signed authorization to obtain payoffs.
  8. Any Home Warranty Information, if applicable
  9. Copies of any relevant Wills, Trusts, Powers of Attorney or Corporate Documents related to the parties

Please bring the following to the Closing:

  1. An original signed contract including any and all addendums
  2. Any Home Warranty information, if applicable
  3. Copies of any invoices for any repairs, if applicable
  4. The Original Termite
  5. The Original Heating and Air Letter

For the Lender:

Prior to Closing, we will need from you:

 

    • Mortgagee Clause
    • Loan Amount
    • Anticipated closing Date
